General information on the processing of personal data for the LinkedIn presence of Energy2market GmbH
This data protection information explains how Energy2market GmbH (Weißenfelser Straße 84, 04229 Leipzig, hereinafter referred to as “e2m”, “us” or “we”) processes your personal data in connection with the use of the social network LinkedIn and the content published on our LinkedIn company page (hereinafter referred to as “LinkedIn presence”). We therefore inform you below about how and to what extent we process the personal data of our users. Please read the information on data protection carefully in order to understand our position and our handling of your personal data and how we handle it. For terms such as “personal data” or “processing”, the legal definitions from Art. 4 GDPR are authoritative.
Scope of application
This data protection information applies to the LinkedIn presence of e2m within the scope of our own responsibility and to the processing of your personal data within the scope of joint responsibility with LinkedIn (LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland and LinkedIn Coporation, 1000 W. Maude Avenue, Sunnyvale, CA 94085, USA; hereinafter: “LinkedIn”). It does not extend to any linked websites or Internet presences of other providers and to the processing of personal data within LinkedIn’s sole area of responsibility.
Processing by Energy2market GmbH as the provider of the LinkedIn presence
Community functions and product advertising
e2m uses the technical infrastructure and functions of the professional social network LinkedIn. The LinkedIn presence is used for purposes including networking with customers, business partners and interested parties, exchanging information and experience, advertising our events and communicating with users via the post, message, like and comment functions. Registration for events is only possible via the e2m website.
Our LinkedIn presence offers various community functions with which you can interact or contact us, for example by responding to posts, invitations or messages, in particular by leaving comments or “liking” posts, sharing them or forwarding them to other users by message. We would like to point out that the areas are publicly accessible and that any personal information that you publicly post in them can be viewed by others.
The information you provide when registering may also be publicly visible. We cannot control how other users use this information. In particular, we cannot prevent your public comments or reactions in the “Comments” section from being commented on by other users.
When you use our LinkedIn presence, we process personal data such as your LinkedIn user name, your profile picture and the information you have provided to us as part of the interactive functions (e.g. “Like”, comment, share and send). The legal basis for the processing of personal data in the context of the community functions of our LinkedIn presence is Art. 6 para. 1 sentence 1 lit. f) GDPR. Our legitimate interest lies in promoting our activities and offers via the LinkedIn presence and communicating with customers, business contacts and interested parties. We will provide you with the balance of interests free of charge on request.
We have no influence on the storage period of your personal data that you have published in relation to our LinkedIn content. We store your data until the purpose of the processing has been achieved or we restrict the processing if there are legal storage obligations. Community management
We receive messages from you as a user with content that directly addresses us via the private messaging function and the “Comments” function. If you contact us, e.g. to ask us questions about the offer advertised on our LinkedIn presence, we process your LinkedIn user name and the other data or information you provide to us in order to process and answer your questions.
In addition, content such as posts, videos or photos are regularly published publicly on our LinkedIn presence and in other public areas of the LinkedIn social network that are aimed directly at us or concern us (e.g. because offers from e2m are mentioned). We process this content, which is sent to us or published on our LinkedIn presence and other public areas of the social network, in order to be able to respond accordingly. Depending on the type of content, we may respond to it accordingly, e.g. by contacting the authors and contacts to support them in using our offers or by incorporating reviews into the improvement of our offers. We also create evaluations of how strongly content is perceived, including the “likes” given and other interactions with our content, in order to learn from this and continuously improve our public relations work, marketing strategies and advertising campaigns.
The legal basis for the processing is Art. 6 para. 1 sentence 1 lit. f) GDPR. Our legitimate interest is to comply with your requests for information and to organize, facilitate and optimize communication with our users and public communication. We will provide you with the balance of interests free of charge on request.
We delete the data arising in this context after processing is no longer necessary – usually within one year of the end of the respective calendar year – or restrict processing if there are statutory retention obligations. The content posted on our LinkedIn presence or other public areas of the social network can be deleted in the same way as other content that you have created. If at any time you wish to have content you have posted deleted, please send us an email to the email address we have provided.

Communication via LinkedIn messages or e-mail
When you contact us, e.g. via the message function or by e-mail, the personal data you provide will be processed by us to answer your request. The legal basis for the processing is Art. 6 para. 1 sentence 1 lit. f) GDPR or Art. 6 para. 1 sentence 1 lit. b) GDPR if your request relates to a specific offer or a contract with us. We will provide you with the balancing of interests free of charge on request. The data is processed exclusively for processing in the context of conversation and communication. Our legitimate interest lies in responding to your request and organizing communication with you. We delete the data processed in this context after the processing is no longer necessary or restrict the processing to compliance with the existing mandatory statutory retention obligations.
You can object to the processing if the processing is based on the legal basis of Art. 6 para. 1 sentence 1 lit. f) GDPR. When using the messaging function, certain data is automatically processed that is required for the use of the function, in particular to ensure access to the Internet. This includes: IP address, date and time of the server request, time zone difference to Greenwich Mean Time (GMT), content of the request (specific browser or app function), access status, amount of data transferred in each case, browser or app from which the request comes, device type, operating system used and its interface (e.g. Android or IOS), language and version of the operating system and device identifiers. e2m does not process any user data in this context. LinkedIn is solely responsible for this processing. Social recruiting
If you wish to apply for an advertised position on our LinkedIn presence, we will process the personal data you provide, in particular identification data (surname/first name, title, date of birth), contact data (address, e-mail address, etc.), qualification data and other information (e.g. salary expectations, professional priorities, etc.) in order to check your request, assess your suitability for the respective position, process your application internally and, if necessary, forward it to the responsible department. We process your personal data to initiate, carry out or terminate the application process, to communicate with you, to exercise and fulfill the associated legal obligations and, if necessary, for the purpose of legal prosecution. The legal basis for the processing is Art. 6 para. 1 lit. b GDPR in conjunction with § Section 26 para. 1 BDSG. When processing special categories of personal data, which may be the subject of your application, the legal basis for the processing is Art. 9 para. 2 lit. b) GDPR in conjunction with Section 26 para. 3 BDSG, unless we have already obtained your prior consent for special processing processes in accordance with Art. 9 para. 2 lit. a) GDPR in conjunction with Section 26 para. 2 sentence 1 BDSG. § Section 26 para. 2 sentence 1 BDSG. Insofar as the processing of your data in accordance with the aforementioned purposes is based on Art. 6 para. 1 lit. b) GDPR, the provision of your personal data is necessary for the preparation, conclusion, implementation and/or termination of the application procedure or the initiation of the employment relationship or in some cases even required by law. You are not obliged to provide your personal data during the application process. However, if you do not provide your personal data, we may not be able to process your application or contact request properly and may not be able to comply with our legal obligations, meaning that the application process is not possible. We delete the data processed in this context after processing is no longer necessary, or restrict processing to compliance with existing mandatory statutory retention obligations. Application documents will be deleted no later than six months after the rejection notification has been sent. Event invitations and event videos
Events are occasionally announced on our LinkedIn presence, for which you can register via our website. You also have the option of sharing the event with other users. If you register for an event, we will process the personal data you provide when registering, such as your user name, your address and the contact and communication data you provide, such as your telephone number and email address, and, if applicable, the other information you provide for the purpose of organizing the respective event (e.g. for creating the guest list, accreditation and admission control, room and personnel planning and catering planning). The data you provide will also be processed in order to send you your invitation and notifications for the respective event. We may also use this information to detect misuse and for legal defense.
The legal basis for the processing is Art. 6 para. 1 sentence 1 lit. b) GDPR, insofar as the execution of the registration process is necessary for participation in the respective event. The processing of your personal data is necessary and mandatory for the conclusion of the contract. If you do not provide your data, you will not be able to participate in the event. Otherwise, the processing is carried out on the legal basis of Art. 6 para. 1 sentence 1 lit. f) GDPR. Our legitimate interest lies in the control of misuse and, if necessary, an effective legal defense in the event of abusive requests. We will provide you with the balancing of interests free of charge on request. If you register for an event, we will delete your registration data after a period of three years at the end of the respective calendar year.

At events for which you have registered, photos and video recordings may be made (possibly by a photographer commissioned by us) in which you may also be depicted. If you are the main subject of a photograph, the photographer will ask you whether you agree to this and obtain your consent before taking the photograph. We use these recordings to publish impressions of the respective event for the purpose of public relations in the form of visualized reporting and for advertising purposes on our LinkedIn presence and our websites.
Unless otherwise agreed, we will delete any recordings of you made at an event within three years of the end of the respective calendar year of the event or after the photos and videos are no longer used for advertising purposes. The data is processed on the basis of legal regulations that permit data processing. If you are the main subject of a recording, your consent is the legal basis for the processing of your personal data in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR.

For other recordings in the context of public relations work, the legal basis for processing is Art. 6 para. 1 sentence 1 lit. f) GDPR. We have a legitimate interest in enabling our public relations work in the form of visualized reporting on our event within the framework of the statutory provisions, without this being opposed by an overriding interest of the participants in the event. Sponsored Content
To increase the attractiveness and effectiveness of the content published on our LinkedIn presence, we use the LinkedIn Sponsored Content functions via various LinkedIn ad formats (e.g. Single Image Ads, Carousel Ads, Video Ads), e.g. by integrating image sequences (Carousel Image Ads), images (Single Image Ads) and media content (Video Ads) into our posts or automatically transferring event information (Event Ads) into clear ads. Our posts are then displayed as a sponsored ad update on our LinkedIn presence and in the LinkedIn feed of other LinkedIn users who are not yet our followers. We can also use sponsored content and the analysis function to increase the reach of our posts, products and events and determine which posts, products or events were of particular interest to our followers and other LinkedIn users.
If you click on sponsored content, e.g. corresponding posts or content, cookies are set on your device via the LinkedIn Insight Tag. In particular, your personal data is processed in this way, e.g. metadata such as your IP address, timestamp and activities or page events (e.g. information about the call of a post).

Lead Gen Forms
We use the LinkedIn Lead Gen Forms function to attract new interested parties to our offers and to increase future user and customer demand (lead generation) in order to develop new target groups for our offers and to make them aware of our company’s offers, to tailor our products to the interests of our customers and to be able to address them in a targeted and simple manner. For the selection of those users by LinkedIn who are to be shown a specific ad with a form, data on search behavior, the lookalike audience, i.e. information on an initial target group, is processed, which LinkedIn then uses to determine new target groups based on the criteria predefined by us, as well as demographic characteristics such as age, gender, location and language. For this purpose, we provide LinkedIn with characteristics that the users should fulfill when creating the respective forms. If users then click on the call-to-action button in a LinkedIn ad to which a so-called lead gen form is attached, the form is automatically filled in with the contact and profile information of this user. This allows users to submit their data to us as a company without having to enter this data manually or visit the company’s pages, e.g. to register for a newsletter. The data submitted in the form may include, for example, industry, qualification and region, if this information has been provided by the respective LinkedIn user. We can also use this function to determine how often which users decide to submit the respective form (conversion rate) in order to measure the effectiveness of the respective form. We use the data you provide to generate newsletter subscriptions, offer products, services and discounts, and share invitations and registration options for events. The legal basis for processing in the context of the use of Lead Gen forms is your consent in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR. We store your data until you withdraw your consent or until the purpose has been achieved. LinkedIn Ads
The ad formats (ads) provided by LinkedIn enable us to display targeted ads to other users and potential customers in order to draw attention to our content and products and expand our target group. As part of the marketing functions provided within the LinkedIn Campaign Manager, ads can be sent to users via direct message (Message Ads), displayed as a simple ad on the right-hand side of the LinkedIn feed (Text Ads) or personalized to the profile of the respective user (Dynamic Ads). In order to make targeted contact with other users, LinkedIn also offers the option of communicating with users via direct message (Conversation Ads) and thus drawing their attention directly to our products and content.
Using the reporting function and the performance diagram of the LinkedIn Campaign Manager, we can evaluate the results of our advertising campaigns using the various ad formats shown above. These reports contain, for example, information about the number of new followers after the advertising campaign and the interactions with our posts and ads. We can also use the clicks, impressions and interactions to determine which campaigns and ad content are most appealing and effective for our target group. This allows us to target users of our website and LinkedIn users who belong to a similar target group with interest-based ads (“LinkedIn Ads”) when they visit the LinkedIn social network.
As part of the use and evaluation of LinkedIn Ads, aggregated and anonymized analysis data in particular is processed, e.g. clicks, impressions, click rates, number of reactions such as likes, comments, shares and demographic user information such as country and language settings. LinkedIn also processes information that is stored on users’ end devices, such as IP address, browser information and the date and time of the server request.

LinkedIn also processes some of the data in the USA. For data transfer to the USA, there is an adequacy decision of the EU Commission under which LinkedIn is certified. Your rights in relation to data protection
You have the following rights with regard to the personal data concerning you, which you can assert against us:
- Right to information: You can request information in accordance with Art. 15 GDPR about your personal data that we process.

Processing within the scope of joint responsibility for “LinkedIn Page Insights”
As part of the operation of our LinkedIn presence, we receive a statistical evaluation of the reach and interactions of users with our posts, videos, content and responses on our LinkedIn presence via the “Page Insights” function. With regard to the processing of personal data to create these statistical evaluations and reports as part of the respective analysis and insights functions, we are jointly responsible with LinkedIn. The purpose of this analysis in the context of Page Insights is to create statistical evaluations that enable us to adapt and improve customer communication and advertising measures within the framework of our LinkedIn presence and with which we can analyze the use of our LinkedIn presence.
When you visit the LinkedIn website and use the community and application functions, LinkedIn collects your IP address and other information about your usage behavior on our website in the form of cookies and similar tracking technologies (e.g. pixels and insight tags) in the browser of your end device or when you access the LinkedIn app via your mobile device (e.g. smartphone or tablet). In addition, LinkedIn processes data that the user provides to LinkedIn via their profile, such as job function, industry, region, length of service, company size and employee status data. The information collected is used to create a statistical analysis for us as the operator of our LinkedIn presence.
The statistical evaluation using Page Insights for the operators of LinkedIn presence contains aggregated data and anonymized statistics on the use of our LinkedIn presence by LinkedIn users in the form of (campaign) reports, in particular on the attractiveness of our posts and content. In addition, key figures are generated on the number of users reached, the number of clicks and interactions on posts, likes, comments and messages as well as the number of visitors and followers on our LinkedIn presence. The analysis also contains aggregated data and anonymized information about the users of our LinkedIn presence, such as job title, function, industry, company size, employment status, seniority and country demographics.
For this purpose, LinkedIn measures the reach of our posts, mentions, events, etc. based on the types of access sources, external access via websites and apps, impressions (e.g. followers) and how they have led to interactions. Interactions with our posts are also recorded, e.g. the total number of interactions of users with a post. This includes all clicks on the post, including all comments, likes, messages, “follow” information, links and embedded media.
Our legal basis for processing the information from the statistical analysis is Art. 6 para. 4 GDPR in conjunction with Art. 6 para. 1 sentence 1 lit. f) GDPR. Art. 6 para. 1 sentence 1 lit. f) GDPR. Our legitimate interest in receiving statistical evaluations lies in the improvement and adaptation of our advertising measures based on the information collected and the possibility of learning more about the interaction of users on our LinkedIn presence. As the operator of the LinkedIn presence, we do not collect and process any personal data other than the aforementioned personal data in connection with LinkedIn Page Insights. Processing within the scope of LinkedIn’s independent responsibility
We do not know how LinkedIn uses personal data for its own purposes, how long the data is stored by LinkedIn or whether data is passed on to third parties by LinkedIn.
If you are currently logged in to LinkedIn as a user, a cookie with your LinkedIn ID or a link between the LinkedIn ID and the advertising ID is stored on your device when you access the LinkedIn app via your mobile device (e.g. smartphone or tablet). This enables LinkedIn to track that you have accessed a LinkedIn account or content and how you have used it. This also applies to all other LinkedIn content or LinkedIn presences. Finally, LinkedIn also receives and processes information when you view content, for example, even if you have not created a LinkedIn account. This so-called “log data” may include the IP address, browser type, operating system, information about the previously accessed website and the pages you accessed, your location, your mobile phone provider, the device you are using (including device ID and application ID), the search terms you used and cookie information. LinkedIn buttons or plugins integrated into websites also enable LinkedIn to record your visits to these websites and assign them to your LinkedIn account.
LinkedIn also processes your voluntarily entered data such as name and user name, email address, telephone number, profile information, password, contacts from your address book (if your address book is synchronized with LinkedIn), calendar data and, if applicable, your profile picture. In addition, payment and billing information (e.g. credit card details) may be processed if you have registered for a LinkedIn premium service. LinkedIn also evaluates the content you share or create to determine what topics you are interested in, processes and scans messages you send directly to other users for the purpose of providing suggested response options, and may also determine your location using GPS data, wireless network information or your IP address.
This data can be used to tailor content or advertising to you. If you are shown advertising on LinkedIn, we have no influence on the selection of advertising material. LinkedIn controls the advertising material based on your usage behavior within LinkedIn. If you wish to avoid this, you should log out of LinkedIn or deactivate the “stay logged in” function, delete the cookies on your device, close and restart your browser or deactivate the advertising IDs (IDFA for Apple and GAID for Google) on your mobile device. In this way, LinkedIn information that can be used to directly identify you will be deleted. This allows you to use our LinkedIn presence without revealing your advertising ID of the end device. When you access interactive functions (like, share, etc.), a new browser window opens and LinkedIn is called up. After logging in, you will once again be recognizable to LinkedIn as a specific user.
You have the option of restricting the processing of your data in the general settings of your LinkedIn account and under “Data protection” or “Data privacy”. In addition, on mobile devices (smartphones, tablet computers) you can restrict LinkedIn’s access to Contact and calendar data, photos, location data, etc. in the settings there.
